Married or Single Revocable Living Trust Package.
A living trust is a plan stating what you would like to happen to your “estate” (your monetary assets, personal belongings, home and other real property) after you pass away. The term revocable means that this type of trust allows you to make changes to the plan during your lifetime if you so desire, and then becomes irrevocable upon your death. After your death the documents in your Trust serve as a tidy list of who will receive your assets and when they will receive them.
Last Will and Testament.
Rather than choosing either a trust or a will, a Revocable Living Trust Package will include both a Living Trust and a “Last Will and Testament” (aka “Will”). This document serves to make sure all of your assets are where you intend them to be- safely titled into the name of your trust so that they can be distributed according to the terms of the trust. Another important item listed in your Last Will and Testament will be a choice of guardian for your minor children in the event of your passing.
Durable Power of Attorney.
This document, which one hopes to never need, authorizes another person of your choice to act for you in the event of your incapacity due to accident or illness. It is a “just in case” document, which takes effect to allow a trusted person of your choice to conduct your business affairs while you are unable.
Advanced Heath Care Directive.
Like the Power of Attorney, the Advanced Healthcare Directive is a document that is created “just in case” an event occurs leaving you unable to make medical decisions on your own. The power given in an AHCD instructs doctors or medical providers as to whom they can rely on to make decisions on your behalf if you are incapacitated.
Changes to your existing plan.
If you are not starting from scratch, and already have a plan in place, you may want to review and update it. Weddings, divorces, births, deaths, and other changes that life brings are common events that can trigger changes.
